BC3D is a creative services agency providing design, digital, and brand development services. This fulfillment policy outlines how we deliver our services, handle payments, process cancellations, and manage client relationships.Service Delivery PolicyDigital Delivery ProcessAll BC3D services result in digital deliverables (design files, templates, digital assets, etc.)Deliverables are provided electronically via secure file transfer, email, or cloud-based sharing platformsNo physical shipping is involved in our service deliveryDelivery timelines are established in your Project Order and typically range from 5-30 business days depending on project scopeDelivery TimelineProject timelines are confirmed in writing at project commencement and are estimates onlyEstimated delivery dates are not guaranteed and may be subject to change due to circumstances beyond our controlClient feedback is required within three (3) business days of deliverable submissionDelayed client feedback may extend delivery timelinesBC3D is not liable for delivery delays caused by client feedback delays, scope changes, or circumstances beyond our controlIf a project remains inactive due to lack of client response for more than ten (10) business days, a new Project Order may be requiredFile Formats and AccessFinal deliverables are provided in agreed-upon file formats (PDF, PSD, AI, PNG, etc.)Working files are delivered upon project completion and full paymentClients receive perpetual access to their final deliverablesWe maintain backup copies for 90 days post-deliveryPayment and Billing PolicyPayment Schedule50% due upon signing Project Order or service commencement25% due at 75% for RefundsNo refunds are provided for completed work that meets the specifications outlined in your Project OrderRefunds are only provided if BC3D delivers work that does not match the specifications in your signed Project OrderYour exclusive remedy for non-conforming work is to return the work in exchange for a refund of the portion that does not conform to specificationsPartial refunds may be considered only if:BC3D fails to deliver services exactly as specified in the Project OrderTechnical issues prevent delivery of agreed-upon deliverablesBC3D terminates the project due to our inability to performRefund ProcessRefund requests must be submitted in writing within three (3) business days of final deliveryAll refund claims must clearly identify specific issues with deliverablesDisputed deliverables will be reviewed and addressed through our revision process before any refund considerationApproved refunds are processed within 10 business days via original payment methodNon-Refundable ItemsCompleted design work that meets project specificationsTime spent on client-requested changes or revisions beyond the included scopeThird-party expenses already incurred on client's behalfWork performed prior to project cancellationCancellation PolicyClient-Initiated CancellationEither party may terminate the agreement with written noticeUpon cancellation, client is responsible for:All services performed through the termination dateAll expenses and out-of-pocket costs incurredEarly termination fee equal to 10% of the total project feeRights to use incomplete work require written consent from BC3DBC3D-Initiated CancellationBC3D may terminate projects for non-payment or breach of contractUpon termination, clients receive completed work delivered prior to cancellationNo early termination fee applies when BC3D initiates cancellation for causeProject SuspensionProjects may be suspended by mutual agreementSuspended projects resume upon written notice and payment of outstanding balancesSuspended projects automatically terminate after 90 days unless extended in writingRevision and Return PolicyIncluded RevisionsEach service includes initial design presentation plus two (2) rounds of revisionsRevisions must be requested within three (3) business days of deliverable receiptRevision requests must be provided in writing with specific, actionable feedbackAdditional RevisionsRevisions beyond the included scope are charged at our standard hourly rateSubstantial changes (exceeding 50% of original scope) require a new Project OrderAll additional revision work must be approved in writing before commencementDigital Asset ReturnsSince our deliverables are digital, traditional "returns" do not applyClients receive exactly what was specified in their Project OrderDissatisfaction with creative direction is addressed through our revision process, not returnsChange Request PolicyScope ChangesChanges outside the original project scope incur additional chargesChange requests are billed at our standard hourly rate of $350/hourAll changes must be approved in writing via signed Change Order before work beginsTimeline ImpactApproved changes may extend delivery timelinesNew deadlines will be established in writing for all change ordersDispute ResolutionInitial ResolutionAll disputes must be raised in writing within three (3) business days of issue identificationWe will attempt to resolve disputes through direct negotiationBC3D will make commercially reasonable efforts to address legitimate concernsFormal ResolutionIf negotiation fails, disputes may be resolved through mediation and/or binding arbitrationArbitration will be conducted through the American Arbitration Association in accordance with their Commercial Arbitration RulesThe prevailing party is entitled to recover attorney fees and costsWarranties and DisclaimersService WarrantiesBC3D will provide services in a professional and workmanlike manner according to industry standardsAll services and deliverables are provided "AS IS" and "AS AVAILABLE"BC3D makes no other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringementWe do not warrant that our services will meet your specific requirements or expectations beyond what is specified in your Project OrderWe do not guarantee that our services will be error-free, uninterrupted, or free from technical issuesLimitation of LiabilityBC3D's total liability for any and all claims related to our services shall not exceed the total amount paid by client for the specific project giving rise to the claimUnder no circumstances will BC3D be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, business interruption, or loss of dataThis limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise) and even if BC3D has been advised of the possibility of such damagesSome jurisdictions do not allow limitation of liability, so these limitations may not apply to youWarranties and DisclaimersOwnership RightsUpon completion of services and full payment of all fees and expenses, BC3D assigns all copyrights in Final Works to clientTransfer includes delivery of all working files related to Final WorksPreliminary works and agency tools remain BC3D propertyClient receives perpetual license to use agency tools solely with Final DeliverablesPre-Payment RestrictionsNo intellectual property rights transfer until full payment is receivedBC3D retains
